Gitanjali Gets Interim Relief from The High Court

Gitanjali Jewellery Retail Limited (GJRL), a subsidiary of Gitanjali Gems, has secured interim relief from the High Court Of Punjab & Haryana against any “coercive action” arising from a judicial magistrate’s order proclaiming the company and two of its officials offenders under Section 82 of the CRPC in a cheque bouncing case.

There is an ongoing dispute between GJRL and one of its erstwhile franchisees, Chandigarh-based Tara Jewels. The trial court order was passed in response to a complaint by Tara Jewels of bounced cheques worth Rs 1 crore. GJRL alleges that it stopped payment on the cheques drawn in favour of Tara Jewels after non receipt of consignment/memo stock worth nearly Rs 2.7 crore from the latter against which it took the Rs 1 crore security deposit.

The HC will hear the case on November 6. GJRL has prayed for quashing of the judicial magistrate of Chandigarh’s orders against itself and its two officials on the ground that Section 82/83 of the CRPC is applicable to warrant cases only and that the present case is a proceeding under Section 138 of the Negotiable Instruments Act, which is a summons case.

The HC has directed the respondent, Union Territory of Chandigarh, not to pursue any coercive action against the petitioners until November 6, the date of hearing.
