FSSAI first approved packaging then accused Nestle of mislabelling

Nestle India told the Bombay High Court on Tuesday that the Food and Safety Standards Act of India (FSSAI) hadn't given it the data based on which the regulator had banned Maggi noodles in June, reported ET.

The company's lawyer Iqbal Chagla also said FSSAI had previously approved the product packaging, then accused Nestle of mislabeling with regard to monosodium glutamate (MSG) content at the time of the ban.

"The regulator also did not give any notice for a meeting before issuing the ban order," he said. Counsel for the company said that the orders passed by FSSAI and the Maharashtra regulator were based on "worthless" evidence. The division bench comprising justices VM Kanade and BP Colabawalla posted the matter for the further hearing on Wednesday.
